This website is operated by EBO CERAMICS. Throughout this website, the terms “we”, “us” and “our” refer to EBO CERAMICS. By visiting this website or purchasing from us, you agree to these Terms of Service and the policies linked from this website.
 

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. PRICES AND PAYMENT
All prices on the EBO CERAMICS website are quoted in Australian Dollars ($AUD) and are subject to change without notice.

Postage and handling charges are not included in the item pricing – these are calculated upon checkout.

If we identify a genuine pricing or availability error before accepting an order, we may contact the customer to offer the corrected price or cancel the order. If payment has already been received and the order is cancelled, the full amount paid will be refunded using the original payment method. Nothing in this section limits rights under the Australian Consumer Law.
 

DELIVERY
Please ensure that the delivery details entered during checkout are correct. We cannot be responsible for orders delivered to an incorrect address provided to us by you. Shipping charges will apply for orders that have to be re-sent due to incorrect details provided to us. You will receive a tracking number from us once your order is on the way. It is your responsibility to ensure you will be able to receive the parcel. If a parcel cannot be delivered and has to be returned to us, re-delivery charges will apply.

Delivery date estimates are given upon checkout and are good faith estimates only. Delivery locations may be limited by available delivery services. If we cannot deliver an accepted order, we will contact the customer and provide a refund or another remedy required by law.
 

DESCRIPTIONS AND COLOURS
All items for sale at eboceramics.com.au are described and photographed as accurately as possible. We take reasonable care to keep product descriptions, images, measurements and availability accurate and current. If we identify an error affecting an order, we will contact the customer and provide the options required by law. The colours shown are representational only. Actual colours on finished pieces may vary from colours displayed. Colours are mixed and applied by hand and will therefore always vary (which is part of the charm of our ceramics). Due to the slight temperature variations that can occur during the firing process or the position of the piece in the kiln, colours of (under)glazes as well as the clay itself may vary between pieces.

Please note that due to the different settings in monitors, the colours might also vary slightly from what you see on your computer screen. If you need any further clarification, please contact us before ordering.
Each product is handmade and disclosed variations in dimensions, clay, glaze, colour, texture and finish may occur. These variations do not exclude a customer’s rights where a product is faulty, unsafe, materially different from its description or sample, or not fit for a purpose disclosed before purchase.
 

AVAILABILITY AND BACKORDERS
EBO CERAMICS endeavours to keep all online listings up-to-date and accurately list the ceramics available for immediate sale. However, should an item due to unforeseen circumstances be out of stock, and not available to be sent to you immediately, you will be contacted as soon as possible.

We have a large range of sizes, colours, and patterns available in our ceramics collections. Every EBO CERAMICS piece is made by hand. Small variations in dimensions, clay tone, glaze, texture and surface finish are expected. These variations are part of the handmade character of the work and are not faults. it is not always possible for us to have each available option in stock ready to ship, however, we can always make your EBO CERAMICS piece especially for you! If an item is placed on backorder you will be notified when you add the item to your shopping cart. Turnaround time is generally around 2–6 weeks, plus delivery, however, if you need your order sooner for a special occasion, please get in touch with us and we will try our best to accommodate your request. Please note that if an order includes both available and backordered pieces, the complete order will be dispatched when all pieces are ready, unless otherwise agreed in writing.

COPYRIGHT INFORMATION
All of the ceramics, designs, logos, text, and photographs on our website are protected by copyright, owned by EBO CERAMICS and the photographers, and may not be used without permission. The content must not be reproduced, modified, republished, uploaded to a third party, transmitted, posted, or distributed in any way without the express authorisation of EBO CERAMICS. If you would like to feature our work, please get in touch to request images.

 

SECTION 1

ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We may refuse or cancel an order where reasonably necessary, including suspected fraud, unlawful activity, product unavailability, an obvious pricing error, delivery limitations or misuse of the website. If payment has been received and we cancel the order, we will provide a full refund unless the law permits otherwise.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
EBO CERAMICS takes reasonable care to keep product, pricing, availability and website information accurate and current. We may correct errors when they are identified. If an error affects an order already placed, we will contact the customer and provide an appropriate correction, cancellation or refund. Nothing in this section limits rights under the Australian Consumer Law.

MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. This does not affect orders already accepted or any rights that cannot be excluded under the Australian Consumer Law.
 

SECTION 5

PRODUCTS OR SERVICES (if applicable)
We may limit product quantities or delivery locations where reasonably necessary due to product availability, delivery restrictions, suspected fraud, unauthorised resale or an obvious error. We may change or discontinue products that have not already been ordered. These changes do not affect accepted orders or any rights under the Australian Consumer Law.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We may limit or cancel quantities where reasonably necessary, including suspected fraud, unauthorised resale, product availability or an obvious ordering error. We will contact the customer using the details provided with the order. If payment has been received for a cancelled order, we will provide a full refund.

You agree to provide current and accurate order information, including your email address, billing details and delivery address, so that we can process your order and contact you when needed.

SECTION 7

DELAYS AND PRODUCT AVAILABILITY
If we cannot dispatch or supply an order within the stated, agreed or otherwise reasonable timeframe, we will contact the customer as soon as reasonably possible. The customer may accept a revised timeframe or cancel the affected order for a full refund.
This does not limit any rights or remedies available under the Australian Consumer Law.
 

SECTION 8

THIRD-PARTY LINKS
Our website may contain links to independent websites, galleries, stockists, payment providers or social-media services.

Third parties operate under their own terms and privacy policies. EBO CERAMICS does not control their websites, content or business practices.

To the extent permitted by law, EBO CERAMICS is not responsible for loss caused solely by an independent third party. Nothing in this section excludes any responsibility or customer right that cannot lawfully be excluded.
 

SECTION 9

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If you provide a review, photograph or other content for publication, EBO CERAMICS will use it only with your permission. You confirm that you have the right to provide that content and that its use will not infringe another person’s rights.

We will not publish private commission information, project photographs or personal information without the customer’s consent.

We may choose not to publish, or may remove, content that is unlawful, misleading, offensive, infringing or unrelated to EBO CERAMICS.

EBO CERAMICS remains responsible for providing any repair, replacement, refund, compensation or other remedy required by law. To the extent that liability may lawfully be limited, it is limited only to the extent permitted by law. Where these Terms conflict with a mandatory right under applicable law, that mandatory right will prevail.

SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
We may suspend access to the website where a user breaches these Terms or applicable law. This does not affect either party’s rights or obligations relating to an accepted order or any rights under the Australian Consumer Law.
